Study Break, Inc. provides an authenticated platform (the “Study Break” app) that connects students to campus clubs, programs, and resources using real-time events. It is a place for safe and respectful community engagement, and not a place for bullying, harassment, shaming or the degradation of others. The “Study Break” app is only available to registered users located at US-based colleges and universities.

In this document, “we”, “our”, “us”, and any other first person pronouns refer to Study Break, Inc. “You”, “your”, and any other second person pronouns refer to any user/users of the “Study Break” app.

This Privacy Policy applies to your use of the “Study Break” app as well as your relationship with Study Break, Inc. This policy is part of Study Break’s Terms of Use. By using the app, you agree to both our Terms and this Privacy Policy; if you do not agree, please do not proceed.

What information we collect

We collect personal and non-personal data from you when you use our platform. Personal Data is data that includes a personal identifier like your name, university email, phone number, or is data that could reasonably be linked back to you.

You need to have an account to use the “Study Break” app. You can create an account on the app as a student, faculty, or staff member using your university (.edu) email.

How we use your personal data

We use, process and store your Personal Data to provide the “Study Break” app. This includes:

Allowing you to create and customize your profile as public or private, so potential groups can identify you.

Researching new ways to improve the “Study Break” app

Using FERPA protected data only in compliance with the requirements of the statute.

When we may share your personal data

We will only share your personal data with third parties under the following circumstances:

With vendors that are contractually engaged to provide us with services, such as order fulfillment, email management and credit card processing. These companies are obligated by contract to safeguard any personal data they receive from us.

If we believe that disclosure is reasonably necessary to comply with a law, regulation, valid legal process (e.g., subpoenas or warrants served on us), or governmental or regulatory request, to enforce or apply the Terms of Use, to protect the security or integrity of the “Study Break” app, and/or to protect the rights, property, or safety of Study Break, Inc. and its employees, users, or others. If we are going to release your data, we will do our best to provide you with notice in advance by email, unless we are prohibited by law from doing so.

We may disclose or transfer your personal data in connection with the sale, merger, bankruptcy, sale of assets or reorganization of our company. We will notify you if a different company will receive your personal data and the promises in this Privacy Policy will apply to your data as transferred to the new entity.

When we use your non-personal data

Non-personal data is data that itself cannot reasonably be linked back to you or data that is combined with other data in a way that cannot reasonably be linked back to you. We may use and your non-personal, de-identified or aggregated data in a variety of ways to help us understand trends through analytics reports, statistics and other metrics and guides.

Storage, security and how to remove your information

We use industry standard technical, administrative and physical controls to protect your data including encrypting it at rest and as it is transferred from you to the “Study Break” app. While we take reasonable precautions against possible security breaches, no internet transmission is completely secure and we cannot guarantee that unauthorized access, hacking, data loss or other breach will never occur. In the event of a breach, we will take reasonable steps to investigate the situation and, where appropriate, notify affected individuals in accordance with any applicable laws and regulations.

De-activating your account or deleting your personal data

You may request to de-activate your account and to delete information about you. You can request deactivation or deletion by sending a message to support@studybreak.co.

Third party links

If you click on any link in the app that takes you to a website other than studybreak.co, our Privacy Policy and Terms of Use no longer apply.  You may find the Privacy Policy and Terms of Use under “Settings” within the “Study Break” app.

Children

Minors under 16 are not permitted to use the “Study Break” app without express parental consent to both use the app and be bound by our Terms of Use and this Policy. We do not intentionally collect information from minors under 13. If you believe we have collected any personal information from a child younger than 13 years of age, please notify us immediately at support@studybreak.co and we will take reasonable measures to remove that information from our systems.

Payments

Study Break, Inc. provides the ability for users to make payments through the use of a third party payment processor. We do not collect or use any of that payment information. We claim no responsibility or liability for payment transactions.

Final Note

This Policy will change over time. If we make minor changes to the policy without materially changing your rights, we will notify you the modified terms on the app. We will notify you by email or by presenting you with a Privacy Policy to accept if we make a modification that materially changes your rights. When you use the “Study Break” app after a modification is posted, you are telling us that you accept the modified terms. Please contact support@studybreak.co for any cases involving this Policy.
